Agreement
I, the lawful owner or resident of the Mercedes property described below hereby request the City to place an animal trap on the below cited herein for a period not to exceed seven (7) consecutive days for the purpose of trapping animal(s) which have been creating a nuisance, which animal(s) are at running-at-large in my neighborhood.
I hereby authorize Mercedes Animal Control staff to enter my property and set the above mentioned trap(s).
By allowing the City to place the trap on my property and requesting such trap to be placed there, I hereby assume the risk of incidental injury to my own animals and, possibly, to animals owned by others. I agree to hold harmless the City of Mercedes, Texas, its elected officials and city employees, from any and all liability for any cost(s) and/or injuries to said animals or to persons due to the usage of the city trap.
It is clearly understood that the City of Mercedes’ trap is property that will not be abused; and, the animal trap shall be retrieved in much the same condition as when it was dropped off. The cage will remain at the requestor’s property for trapping, and will only be moved due to the needed transport of the animal. The cage will not be placed at any other location. If cage is lost or damaged due to its misuse, signee is responsible for covering the cost of repair or replacement of the city’s trap. If the signee shall not comply with the provisions cited herein, no further trap will be forthcoming to said resident, and the City may issue a citation to retrieve the costs involved.
Rules and Regulations: Traps will be loaned for a period of seven (7) Days.
1. Animal Control Officer or designee will remove domestic animals caught in our traps
2. Animal Control is not responsible for placing food in the traps.
3. The resident is responsible to notify the Animal Control Officer by calling (956) 565-3102 during working hours (8:00 am-5:00 pm, Mon-Fri) when an animal has been secure.
4. Resident must provide humane treatment of the animal while in the cage. The resident is responsible to care for any animal secured in a cage after regular hours, evenings, weekends or statutory holidays. The Animal Control Officer must be notified as soon as possible during the next regular working day.
5. Traps will be delivered to the property below within 48 to 72 hours of receiving the request. Resident understands that traps depend on their availability.
6. Resident/Owner shall be responsible for a lost trap or a trap damaged due to mis-use.
